Terms and Conditions – CometLab Membership

 

1. Introduction​

These Terms and Conditions govern membership and the use of CometLab facilities, equipment, and services (hereinafter referred to as “CometLab”).

By registering as a member or using CometLab facilities, the member agrees to comply with these Terms and Conditions, CometLab safety regulations, and any additional operational policies issued by CometLab.

CometLab is a shared workshop environment intended for learning, experimentation, prototyping, and collaborative innovation.

2. Definitions​

For the purposes of these Terms and Conditions:

​

CometLab – the organization operating the makerspace and providing access to equipment and facilities.

Member – any individual who has registered and has been granted membership access to CometLab.

Facilities – all spaces, machines, tools, and equipment available within CometLab.

​

3. Membership Eligibility​

Membership is available to individuals who:

​

  • Are at least 18 years of age, or are supervised by a legal guardian where permitted.

  • Have completed the required registration and orientation process.

  • Agree to comply with all applicable safety instructions and operational rules.

CometLab reserves the right to refuse membership where reasonable grounds exist.

4. Membership Types

CometLab may offer different membership tiers (for example: Basic, Standard, Pro). Each membership tier may include different levels of access, services, and pricing.

Details regarding membership tiers, access rights, and pricing are provided separately and may be updated periodically.

5. Access to Facilities

Members may access and use CometLab facilities only:

​

  • During designated opening hours or permitted access periods;

  • In accordance with their membership level;

  • After completing required training or certification for specific machines.

​

Access credentials (such as keys, access cards, or digital access codes) are strictly personal and may not be shared.

​

6. Safety and Training

Members must prioritize safety at all times.

Members must:

​

  • Complete required safety training before operating equipment.

  • Follow all machine instructions and safety guidelines.

  • Wear required personal protective equipment (PPE).

  • Report accidents, injuries, or unsafe conditions immediately.

​​

Members may not use machines while under the influence of alcohol, drugs, or any substance that may impair safe operation.

CometLab reserves the right to deny access to equipment where safety procedures are not followed.

​

7. Use of Equipment

Members must use equipment responsibly and only for its intended purpose.

Members agree to:

​

  • Use only approved materials on machines.

  • Never leave running machines unattended where supervision is required.

  • Clean workspaces and machines after use.

  • Report malfunctions or damage immediately.

​​

If damage results from negligence or misuse, CometLab may recover reasonable repair or replacement costs from the responsible member.

​

8. Conduct and Community Standards

CometLab is a collaborative and inclusive community environment.

Members must:

​

  • Treat other members, staff, and visitors with respect.

  • Refrain from harassment, discrimination, or disruptive behaviour.

  • Follow instructions given by CometLab staff.

​​

Failure to comply may result in temporary or permanent removal from the facility.

​

9. Materials and Storage

Members are responsible for their own materials and projects.

The following rules apply:

​

  • Only approved materials may be used with CometLab equipment.

  • Hazardous materials require prior approval from staff.

  • Temporary storage of projects may be permitted but is not guaranteed.

  • Unlabelled or abandoned items may be removed after a reasonable period.

​​

CometLab is not liable for loss, theft, or damage to personal items stored on the premises.

​

10. Intellectual Property

Members retain ownership of the intellectual property associated with their projects.

Members are encouraged to share knowledge and contribute to the open and collaborative spirit of CometLab community.

With permission, CometLab may document or showcase member projects for educational or promotional purposes.

11. Fees and Payment

Membership fees, usage fees, and material costs must be paid according to the pricing structure published by CometLab.

Unless otherwise specified:

​

  • Fees are payable in advance.

  • Fees are non-refundable except where required by law.

  • Non-payment may result in suspension of membership.

​​

12. Liability and Risk

The use of workshop tools and fabrication equipment involves inherent risks.

To the extent permitted by Dutch law (including Article 6:162 of the Dutch Civil Code), CometLab shall not be liable for damage, injury, or loss arising from:

​

  • Improper use of equipment;

  • Failure to follow safety instructions;

  • Negligent behaviour by members.

​​

Nothing in these Terms excludes liability for damages resulting from intentional misconduct (opzet) or gross negligence (grove nalatigheid) by CometLab.

Members participate in CometLab activities at their own risk.

​

13. Prohibited Activities

The following activities are prohibited within CometLab:

​

  • Illegal activities under Dutch law;

  • Manufacturing weapons or prohibited items;

  • Unsafe or hazardous processes without authorization;

  • Activities that damage equipment or endanger others;

  • Commercial mass production that interferes with community use.

​​

CometLab reserves the right to determine whether an activity is inappropriate or unsafe.

 

14. Suspension and Termination of Membership

Termination by the Member

Members may terminate their membership at any time, but at least 2 weeks before the end of the subscription period. Membership can be terminated by providing a written notice to CometLab (info@cometlab.nl).

Where membership involves a subscription period, termination will take effect at the end of the current billing period unless otherwise agreed.

Termination by CometLab

CometLab may suspend or terminate membership with immediate effect if a member:

​

  • Violates safety rules;

  • Misuses equipment;

  • Fails to pay membership fees;

  • Engages in disruptive, abusive, or illegal behaviour.

​​

Where possible, CometLab will provide written notice explaining the reason for termination.

Termination of membership results in loss of access to CometLab facilities.

​

15. Changes to Terms

CometLab reserves the right to amend these Terms and Conditions.

Members will be informed of significant changes in advance. Continued use of CometLab after such notification constitutes acceptance of the updated terms.

​

16. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Netherlands.

Any disputes arising from these Terms shall be submitted to the competent court in the Netherlands.
